There are various factors which influence the prosecutorial decision in civil and criminal proceedings. In criminal proceedings, the main factors that influence the prosecutorial decision are mostly the evidence before them which is mainly presented and described in the police report. The other factor is political ambition and the gains that come from prosecuting a crime since many prosecutors are elected officials, and they usually view their position as a stepping stone to a higher office. The factors that influence the prosecutorial decision in a civil proceeding is the sense of what justice requires in a particular case.
