Running head: milestone 1 0 Milestone One Satonga Brown JUS-325 Southern New Hampshire University Milestone 1 Incest is a process of having sex or marrying close relatives from a similar line of blood. It mostly involves having sex with your siblings, children or even parents. A family law relationship considers both the mentioned sexual relationship from adoptive relatives as incest (Crofts, 2007). According to the Criminal Law Amendment Act, 1885, such relationships are illegal (Rollin, 2007). However, this relationship can be ignored if, for instance, a boy and a girl were separated from birth and they did not know that they are relative. The common law of incest totally prohibits sexual relationship between adults and children, with or without knowledge about their blood similarity. If this happens, it is considered child sexual abuse. Most communities restrict incest since children born from this close relationship have high chances of getting congenital disorders, physical disabilities as well as death (Rollin, 2007). It is, therefore, the obligations of guardians and parents to bring awareness to their children concerning association to avoid incent relationship. In the twentieth century, incest marriage was observed as a matter of authority from churches. That to say, it was not a crime and the law courts had nothing to do with it. However, the legal situation has currently changed and actions are taken against it. Additionally, most of the marriage rights both in the country and in the world are against incest. Incest law is taken very seriously. In fact, the offenders are sentenced in prison for a period of not less than 25 years (Lagodny, 2011). In return, this has reduced both the rate of incest in the society and professional family as well, where incest was not observed as a crime. References Crofts, P. (2007). Running head: milestone two 0 Milestone Two: Annotated Bibliography Satonga Brown JUS-325 Southern New Hampshire University Annotated Bibliography Crofts, P. (2007). Sex in the Dark: The Brothels Legislation Amendment Act 2007 (NSW). Current Issues In Criminal Justice, 19(2), 183-196. doi: 10.1080/10345329.2007.12036425 This article was written by Crofts in 2007, concerning sex in the dark. It has a legislation amendment act that was developed in and passed by the Parliament New South Wales with an aim t unlawful and disorderliness. The article describes incest as a brothel, where people from the same house or relatives engage in sexual activities. According to the article, the brothel is illegal and the legislation aimed at imposing orders on the sexual industry by enforcing the harsh regime of exclusion and expulsion. Additionally, the article argues the reasons for making reforms towards brothels (incest). The main aim of reducing incest according to the article is that it has a negative attitude towards children born out of it. Therefore, it was necessary for the government to come up with laws of eliminating brothel, through using planning powers. Lagodny, O. (2011). Basic rights and substantive criminal law: The Incest Case. University Of Toronto Law Journal, 61(4), 761-781. doi: 10.1353/tlj.2011.0026 In this article, Lagodny talks about the basic rights and the law of substantial criminal and specified the investigation in the basic rights. According to the researcher, sexual rights are involved in the basic rights of human beings. The researcher aimed at investigating the extent to which basic rights in the constitution limits the legislator in criminal law. Lagodny referred to incest as a form of the criminal act. Public interest, especially on sexual activities plays its role as preliminary factor in the arena of criminal law. Since the law was implemented in Germany, the country introduced incest punishment between natural siblings. This signified that incest is illegal and Germany was against it. Rollin, H. (2007). Criminal Law Amendment Act, 1885, s. 5 (2); an offense against imbecile woman; definition of ‘imbecility’. British Journal Of Psychiatry, 190(4), 365-365. doi: 10.1192/bjp.190.4.365 The article emphasized the offenses done against an imbecile woman. The article talks about a case that presented before the court concerning the imbecile woman. Imbecility means having a form of physical or mental disabilities. The jury involved argued that most of such cases usually happen to people from the same families. Therefore, it is a form of victimization done to imbecile people in the family. Sometimes the woman or person involved might have the understanding and fail to overcome the persuasion from the partner. From the case, the defender was indicated to have an offense under section 5(2) of criminal law and amendment act. Precisely, the article shows that incest if an illegal act and effective laws should be taken against it.
